Three registers: the House email about buying competitors, the Instagram research gap, and the LibGen memo that used his initials as a destination. Not a mailbox. A stack of pairs.

A dataset we know to be pirated… in no case would we disclose publicly that we had trained on libgen.

The public register is fair use and precaution. The private register is a known-pirate library plus an instruction not to say so. The instruction is the preference falsification.

The tell · When a memo discusses disclosure strategy before it discusses the work, the audience has already split.

How this became public: Unsealed in Kadrey v. Meta discovery briefing.

Public

CEO, public and later sworn settings

Senate-adjacent comments and later trial testimony

Zuckerberg has said the research is ambiguous, does not clearly prove harm, and that Instagram’s effect on teens is debated internally with equities on all sides.

Email

As a parent of two teenage girls … I can tell you the pressure on them and their peers coming through social media is intense with respect to body image. There won’t be hard data to prove causal harm for many years, if ever.

The CEO’s public register waits for causal proof. The VP’s private register says the proof will arrive late, and the pressure is already visible. Those are different standards for the same children.

The tell · “We need causal evidence” is sometimes a preference about timing, not about care.

How this became public: Email surfaced in later teen-harm litigation and reporting on Zuckerberg’s after-leak messages.

The company said the Journal focused on a limited set of findings, that the research was part of a commitment to understanding hard problems, and that Instagram is helpful for most teens.

internal research slide

Facebook Workplace / research deck

We make body-image issues worse for one in three teen girls. Thirty-two percent of teen girls said that when they felt bad about their bodies, Instagram made them feel worse.

The public register is net-helpful and methodologically humble. The private slide is a rate. Testimony-gap is when Congress and parents get the first and staff get the second.

The tell · If the research slide would be a headline, and the press line is “it’s complicated,” you are looking at two audiences.

House Judiciary 2020 production

It is better to buy than compete. We can likely always just buy any competitive startups.

The public market is exit. The private market is acquisition. Instagram later became the worked example.

The tell · If the founder writes “buy rather than compete,” believe the email, not the concentration speech.

How this became public: House Judiciary Committee antitrust document dump, 2020.
